Patent non-assertion pledge

This page is the canonical, permanently-hosted home of the patent non-assertion pledge that the @ariada-org/* package NOTICE files reference. Where any package NOTICE and this page differ, this text governs.

The pledge is made by Agonist Development AB and applies to every good-faith open-source user of the published packages. It is written in plain words on purpose: a contributor, a fork maintainer, or a procurement reviewer should be able to read it once and rely on it.

The commitment

Agonist Development AB makes the following binding, public, and irrevocable commitment with respect to its published open-source packages:

We will not assert any patent — including any of our pending United States patent applications, and any patents that may later issue from them — against any good-faith user of these packages who uses them through their documented public API.

A one-way ratchet

This pledge is a one-way ratchet: it may be broadened, never narrowed, and it survives the conversion of any pending application into a granted patent. A user who relies on it today does not lose that reliance if a provisional application later matures into an issued patent.

Additive to the EUPL-1.2 licence

This pledge is in addition to, and more generous than, the patent licence already granted automatically to every licensee under Article 2 of the EUPL-1.2. The licence grants the patent rights necessary to use the work; this pledge additionally covers good-faith open-source users against the broader portfolio.

Reciprocity

The pledge is reciprocal. It terminates, for a given party, only if that party initiates patent litigation alleging that one of these packages or its documented use infringes a patent. Good-faith users who do not bring such litigation are never affected by another party’s conduct.

Scope and authority

The pledge covers the published @ariada-org/* packages when used through their documented public API. It is reproduced in full in the NOTICE of @ariada-org/wcag-rules-extended and referenced from the NOTICE of every other published package. This page is the canonical reference for all of them.
